Dear Colleague:

It seems that the heat has been turned up in Florida. Florida eminent domain practitioners, both for condemnors and condemnees, are far busier these days than in the not too distant past. In fact, public acquisition of private property is on the rise as substantial number of major public infrastructure projects are in full swing.

As well, many of these projects are being implemented under the new paradigm of “Design-Build” which has altered the familiar context to which both a condemnor’s acquisition policy and practice applies. So too, it seems that cases generally are subject to more litigation than before and the possibility of trial is ever greater.

Indeed, this year’s course of study is a “can’t miss” as we unpack from a number of recent encounters from across the state. Presentations will be designed to not only keep practitioners current on what is happening throughout the state, but to explore ways and means of confronting new challenges. Moreover, attendees will benefit from informative case law updates in eminent domain, growth management, and exaction law.

Keynote Address – Joseph T. Waldo, Waldo & Lyle, Norfolk, VA

• New Challenges in Hearings on Orders of Taking

• Judicial Perspectives on Voir Dire and Design-Build Challenges

• Strategies for Exposing a Faulty Appraisal Premise or Analysis through Discovery, Deposition, and Cross-Examination

• Legal Updates on Growth Management and Environmental Legislation Affecting Eminent Domain, and on Bert J. Harris Jr. Private Property Rights Protection Act Cases

• Attorneys’ Fees and Costs

• Highest and Best Use Analysis

• A Panel Discussion on Successful Litigation Strategies Known as Humdingers

This course of study is designed to be helpful to legal practitioners, valuation witnesses, and those involved with right-of-way acquisition alike. We look forward to this year’s CLE-International Eminent Domain Conference and hope to see you there with us in Tampa, Florida!

Sincerely,
